Data Protection Impact Assessments (DPIAs): If collecting large amounts of sensitive personal data, businesses may need to conduct DPIAs to assess the impact on individuals' privacy rights. In addition to GDPR, the PECR specifically governs electronic communications, including email marketing in the UK. PECR covers: Opt-in Requirements: Under PECR, businesses must obtain UK Email Database prior consent from individuals before sending marketing emails, unless the individual is an existing customer and the email relates to similar products or services. Soft Opt-In: There is an exemption for businesses that have obtained an individual’s email address in the course of a sale or negotiations for a sale of a product or service. The exemption, known as "soft opt-in," allows businesses to send marketing emails without explicit consent, but only under certain conditions (e.g., the marketing must be for similar products or services). Opt-out Mechanism: Every marketing email must provide a clear and easy way for recipients to opt out of further communications. 3. Data Protection Act 2018 (DPA 2018) The Data Protection Act 2018 supplements the GDPR in the UK. It provides additional rules related to the processing of personal data, including specific rules for processing data in areas such as direct marketing.
